DEFINITIONS

  • Us/We/Our/The Company – refers to WebMinglers, WebMinglers Corporation (Pty) Ltd and any of its subsidiaries as well as third party services in partnership with the company.
  • Businesses/Client(s)/Customer(s) – refers to parties who use any of our services and products whether directly or through any of our subsidiaries.
  • Account/Client Portal – refers to any access provided to the customer to control paid resources.

At WebMinglers, in our quest is to provide the best services and products we have set unlimited* plans for hosting features such as Storage, Business Emails, Sub-domains, Databases and Bandwidth. Our objective is to ensure that our clients can focus more on their business while we handle the server infrastructure at the best price point possible. Any usage that affects or hinders our capability to provide other customers our services is strictly prohibited and may result in the termination of the account.

Unlimited* means that there are virtually no restrictions when it comes to a specific feature such as Storage, Business Emails, Sub-domains, Databases and Bandwidth however we do have a Fair Usage Policy that ensures that our services, products and objectives are not exploited or abused.

 

 

Target Customers

Our server infrastructure is configured for unlimited shared hosting to cater for the following target audience listed below. We recommend independent cloud solutions to customers who are outside of the pre-defined cohort below, also feel free to request a quote for such extended cloud services:

  • Small & Medium Businesses
  • Freelance Developers
  • Entrepreneurs
  • Startup Companies
 

Unlimited Storage / Disk Space

Storage or Disk Space is unlimited as long as it is being used as part of the website and there is no intentional or deliberate abuse of resources such as storage of copyrighted video files or large files that are unrelated to the website content. We reserve the right to suspend your account, refuse service or request migration to other service providers if the customer account exceeds our server threshold as a percentage respective to our infrastructure.

 

 

Unlimited Business Emails & Email Storage

Creation and storage of business emails is unlimited as long as the business emails are active and do not violate any of the following email policies:

  • Long term storage of emails is not allowed and we reserve the right to purge or remove emails that are older than 12 months automatically using our system,
  • Spam folder emails older than 90 days, we reserve the right to delete them,
  • Deleted folder emails older than 90 days, we reserve the right to delete them,
  • For Inactive/Dormant/Unattended mailboxes that are older than 12 months may be deleted
 

Unlimited Sub-domains

Creation of sub-domains is unlimited as long as the sub-domains created relate to the main website, are active and do not violate any of our company policies.

 

 

Unlimited Databases

Creation of databases is unlimited as long as the databases created relate to the main website, are active and do not violate any of our company policies. Our server infrastructure is configured to provide MySQL databases including access to PHPMyAdmin for each Control Panel.

 

 

Unlimited Bandwidth

Bandwidth usage is unlimited as long as the usage can relate to the main website and does not violate any of our company policies.

 

 

Content & Data Policy

The products and services that are offered at WebMinglers are to be used for lawful purposes only. Any storage or transmission of any content or data that violates the South African Law is strictly prohibited. Any content, file or data that violates South African Law, United States Federal Laws, and United Kingdom Laws, European Laws or any other region not mentioned is strictly prohibited. Prohibited content, files and data includes but is not limited to trademarked material, copyrighted material, intellectual property, protected or sensitive material, obscene content or any content that can be considered harmful to other parties. WebMinglers will fully co-operate with the authorities if we deem that any of our products and services are being used for any nefarious purposes. Prohibited content, files or unacceptable data includes the following but is not limited to:

  • Adult Obscene Content
  • Shock Site Content
  • Online Gambling
  • Spam Content
  • Scam Content
  • Copyrighted & Trademarked Material
  • Fraudulent Content
  • Hacking Software
  • Pirated Software Programs

We hold our customers responsible and liable for any content, file or data stored under their account and we will fully co-operate with authorities as well as file legal proceedings of our own.

 

 

Spamming Policy

Any use of our products and services for the purpose of spamming including unsolicited commercial emails is strictly prohibited. WebMinglers does not permit the sending of emails, storage of emails, hosting of email accounts that are used to spam other parties. Violation of any of our policies will invoke termination or suspension of the customer account without notice and we will co-operate with authorities as well as file legal proceedings against the perpetrator.

 

 

Domains Policy

Any rules and regulations from third party domain registrars or vendors that WebMinglers does business with will be extended to the customer and the customer is expected to comply with those regulation.

 

 

Premium Domains Policy

WebMinglers partners with multiple domain registrars in order to provide our customers access to a variety of domains including premium domains which may incur extra charges. It is possible that our pricing may need to be adjusted if the premium domain incurs any extra fee, at that point the customer can either pay the extra fee to secure the domain or request a refund for the partially paid premium domain. 

 

 

Domain Refund Policy

WebMinglers is NOT responsible for domain name spelling mistakes or errors which means that any fees paid for a misspelled domain are NON-REFUNDABLE. If a customer buys a domain and realizes that they misspelled the domain name, they will NOT be refunded and will have to purchase another domain with the correct domain name.

 

 

Shared Resource Usage Policy

We provide shared resources to our customers and any usage that hinders the progress of other customers is strictly prohibited and may result in the termination of services without notice.

 

 

POPI Act & Data Protection

We collect personal information in accordance to the guidance of the POPI Act of 2013. Any information provided to us also extends your consent to the company to use the information with its subsidiaries for the purpose of security and improving our services.

 

 

Refusal of Service

WebMinglers reserves the right to refuse service to anyone for whichever reason deemed fit to be in violation to the policies by the company and its subsidiaries.

 

 

Termination of Service

WebMinglers reserves the right to terminate services without notice to anyone for whichever reason deemed fit to be in violation to the policies by the company and its subsidiaries.

 

 

Liability

WebMinglers and its subsidiaries are not liable for any damage or loss that is a result of the use of our services by our customers or any third party associated with us.

 

 

Payments

Our payment services are powered Paystack Payment Gateway to receive online payments such as EFTs, Credit Cards (MasterCard & VISA). Alternatives, we also accept direct bank deposits. We require full payment upfront for domain and hosting services but we also offer various payment plans for other products and services. Payment reminders will be sent to customers at least 2 weeks before the due date.

 

 

Late Payments

WebMinglers and its subsidiaries extend the responsibility of timely payments to the customers considering the payment reminders sent to the customer so in the event of late payments we reserve the right to terminate or suspend services with immediate effect on or after the due date. We have no guarantee of data backup once the service has entered the termination or suspension phase.

 

 

Service Cancellations

Customers are free to cancel services anytime directly inside the customer portal if available or alternatively simply email your cancellation request to cancellations@webminglers.co.za . Please note that cancellation of services does not cancel any outstanding invoices or payments.

 

 

Backups

WebMinglers performs periodic server infrastructure backups for the purpose of server management so we extend the responsibility of local backups to the customer and we highly recommend the customer to keep updated local backup copies of their data as part of their disaster recovery strategy.

 

 

Service Uptime

WebMinglers has an optimized server infrastructure to ensure the service uptime is highly available however we do not guarantee and are not liable to the 99.9% service uptime because of the possibility outages or system failure beyond our control.

 

 

Customer Support

WebMinglers supports customer queries via either email: support@webminglers.co.za or via the Live Chat on the website. We highly recommend the use of the customer portal if available to log any support queries.

 

Marketing & Advertising

WebMinglers and its subsidiaries reserve the right to the usage of the customer content and metadata that were provisioned as part of our service offerings in our marketing offerings and strategy online or otherwise.

 

 

Terms & Conditions Modifications

WebMinglers and its subsidiaries reserve the right to modify and update the Terms and Conditions as well as any other agreements at our sole and absolute discretion without prior notice.
